Issues
A mom with a developmental disability sued Rio Blanco County for discrimination under Title II of the ADA when the county refused to provide reasonable modifications to policies, practices and procedures, and for retaliation. The mother, whose son was placed into foster care, asked for reasonable modifications to be able to complete her treatment plan.
Status
Plaintiff filed her complaint in federal court on November 10, 2005. She filed a motion for a preliminary injunction on November 14, 2005. An evidentiary hearing was held on December 28, 2005, and we are awaiting a ruling. We lost the preliminary injunction, and the case settled.
