Issues
Nationwide class action involving ADA violations at both newly constructed facilities and existing facilities: Inaccessible credit card readers, parking, exterior access to stores blocked, counter heights, interior access obstructed.
Status
Case was filed October 27, 1999; moved for nationwide class certification on November 11, 1999. The class was certified on August 22, 2000. After lengthy negotiations, the parties have reached an agreement. The Fairness Hearing was held on September 6, 2002, at 9:00 a.m., before the Honorable Marcia S. Krieger, in the Federal District Court of Colorado. The Court approved the Class Action Settlement Consent Decree. The parties are now engaged in the monitoring and review process required by the Consent Decree. The Court-approved Consent Decree can be downloaded here.
