Issues:
Bethany Christian Services, a child placement agency, removed foster children placed with plaintiffs after the foster mother experienced a stroke and seizure. The agency said they were concerned about the foster mother's medical condition. Despite letters from the foster mother's doctors stating she had no limitations in her ability to parent, the foster children were removed and not returned. The child placement agency then revoked the foster parents' license and interfered with their attempts to foster other children through another agency, again citing their concerns about the foster mother's ability to parent because they regarded her as having a disability affecting her ability to parent.
Status:
Plaintiffs filed their complaint in federal court on April 26, 2004. Settlement was reached in early 2005.
