Supported Living Services (SLS)

Issues

CCDC is investigating possible ADA Olmstead violations with the new Supported Living Services ("SLS") funding caps. We believe the caps may violate the Americans with Disabilities Act when the caps put people at risk of institutionalization or placement in less restrictive settings. While we know the caps are affecting up to 400 Coloradans receiving Medicaid services under the SLS waiver, the caps are not putting all those individuals at risk of institutionalization. Some people can receive services under a different waiver, and others may not have substantial cuts in their services.


We would like to hear from you if you or a family member are in one of the following situations:


A. The individual with a developmental disability lives independently in the community (or with a roommate), and the new SLS caps place the individual at risk of placement in a more restrictive setting (with family, group home, or host home).


B. The individual with a developmental disability lives with family, but the new caps place that individual at risk of nursing home, regional center, or other congregate facility placement.
