Colorado Cross-Disability Coalition, et al. v. Women's Health Care Associates, 10-cv-01568-RPM-KMT

Issues

Plaintiff Daisy Midthun is deaf and has received services from Women’s Health Care Associates (“WHCA”).  Ms. Midthun has informed WHCA that the interpreters it provided were not communicating effectively as is required under the ADA.  She requested different interpreters.  WHCA responded that she is not entitled to interpreters of her choice even though Ms. Midthun made clear she was not receiving effective communication during appointments.  CCDC’s Legal Program wrote to WHCA in an effort to resolve this issue.  WHCA never responded.  CCDC’s Legal Program filed a lawsuit in federal district court on July 1, 2010.
