Citation

Reiskin et al. v. Regional Transportation District et al., 14-cv-02285-KMT

Issues

On the 24th anniversary of the ADA, RTD opened the newly renovated Union Station, which features an elevated area that is only accessible by stairs. RTD entered into a lease agreement with the Union Station Alliance, the entity that was responsible for making all renovations to the Grand Hall where the elevated area is located. The entire interior of the Grand Hall was altered. The elevated area was added after the renovations occurred. A person using a wheelchair could find someone and ask them to locate a portable ramp to access the area.  The lawsuit alleged this violated the alterations provisions of the Americans with Disabilities Act and the 2010 Standards for Accessible Design.

Status

The lawsuit was filed on August 19, 2014. On November 3, 2014, CCDC entered into a settlement agreement with the Union Station Alliance on behalf of itself and RTD. These documents are available here
