This case involves Medicaid eligibility under Section 1619(b) of the Social Security Act.
Kevin Williams filed an appeal after receiving two conflicing letters regarding his Medicaid eligibility. One letter was a Notice of Action that said that he would remain Medicaid eligible through 2/29/12. The other letter from the County said that his eligibility ended on 10/31/11. Section 1619(b) allows Medicaid recipients to earn income above normal levels and still remain Medicaid eligible. The Department tried to terminate Mr. Williams’s Medicaid eligibility based on his income level, which is in violation of Section 1619(b) rules.
The State resolved this matter. The appeal has been dismissed.
